These Terms of Service ("Terms") govern your access to and use of FortuneTell.ai (the "Service"), including our website (fortunetell.icehe.life) and our iOS application. By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 17 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

2. Account Registration

• You must provide accurate information when creating an account
• You are responsible for maintaining the confidentiality of your credentials
• You are responsible for all activities under your account
• One person may not maintain multiple active accounts
• We reserve the right to suspend or terminate accounts that violate these Terms

3. Service Description

The Service provides AI-powered fortune-telling, divination, and astrological interpretation tools, including but not limited to:

• BaZi (Eight Characters) astrology
• ZiWei DouShu (Purple Star astrology)
• Tarot card readings
• Liu Yao divination
• Qi Men Dun Jia
• Face and palm reading
• Dream interpretation
• AI-generated personalized readings

4. Entertainment Purpose Only — Critical Disclaimer

THE SERVICE IS PROVIDED FOR ENTERTAINMENT PURPOSES ONLY.

• All readings, interpretations, predictions, and AI-generated content are speculative and do not constitute professional advice of any kind, including but not limited to medical, legal, financial, psychological, religious, or relationship advice
• Fortune-telling and divination are not science. Results have no proven predictive validity
• AI-generated content may contain errors, biases, hallucinations, or fabrications
• You are solely responsible for any decisions or actions you take. Do not make important life decisions (medical treatment, financial investments, ending relationships, legal matters, etc.) based on the Service
• If you are experiencing a crisis (mental health, suicidal thoughts, domestic violence, medical emergency), seek qualified professional help immediately. The Service is not a substitute

5. Subscriptions and In-App Purchases

5.1 Apple In-App Purchase (iOS)

All purchases on the iOS app are processed through Apple's In-App Purchase system. By purchasing, you also agree to Apple's Terms of Service and EULA.

5.2 Auto-Renewable Subscriptions

• Subscription fees will be charged to your Apple ID on confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple ID account settings
• No cancellation of the current subscription is allowed during the active period; you may cancel for the next period only

5.3 Coins (灵值)

• The Service uses an internal currency called "灵值" (Coins) to access certain features
• Coins are granted with active membership and consumed when you use AI services
• Coins have no monetary value, are non-refundable, and cannot be exchanged for cash
• Unused coins do not carry over after subscription expires

5.4 Web Payments (Stripe / Z-Pay)

Web purchases follow the respective payment processor's terms. Refund policies are subject to our refund policy below.

5.5 Refund Policy

• iOS purchases: Refunds are handled by Apple per Apple's policies. We cannot directly refund iOS purchases
• Web purchases: Refunds may be requested within 7 days of purchase if the Service is not delivered. Used coins are non-refundable. Contact support@fortunetell.ai

6. Intellectual Property

• The Service, including all software, designs, text, graphics, and AI-generated content (excluding your inputs), is owned by FortuneTell.ai
• You retain ownership of your inputs (questions, birth info, photos), but grant us a worldwide, royalty-free license to use them solely to provide and improve the Service
• AI-generated readings: you may use them for personal, non-commercial purposes; commercial redistribution requires our prior written consent

7. Acceptable Use

You agree NOT to:

• Use the Service to harm, harass, or deceive others
• Submit illegal, hateful, sexual, or violent content
• Attempt to reverse-engineer, decompile, or extract source code
• Use bots, scrapers, or automated tools to access the Service
• Bypass payment, rate limits, or authentication
• Use the Service to provide commercial fortune-telling to others without our written consent
• Submit personal information of others without their consent (e.g., reading someone else's birth chart without permission)
• Interfere with the Service's operation or other users' access

8. User-Generated Content

You are solely responsible for the questions, photos, and other content you submit. We may remove content that violates these Terms or applicable laws without prior notice.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated by reference into these Terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

We do not warrant:

• That divination results are accurate, predictive, or meaningful
• That the Service will be uninterrupted or error-free
• That AI-generated content is factually correct, unbiased, or appropriate

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FortuneTell.ai AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

12. Indemnification

You agree to indemnify and hold FortuneTell.ai harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 4, 6, 10, 11, 12, 14 survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be resolved by binding arbitration in Hong Kong under the rules of the Hong Kong International Arbitration Centre (HKIAC), except that either party may seek injunctive relief in court for IP infringement.

You waive the right to participate in class actions to the extent permitted by law.

15. Apple-Specific Provisions (iOS Users)

The following provisions apply only when you access the Service via our iOS application, and are required by Apple Inc. ("Apple") for any application distributed via the Apple App Store. To the extent these provisions conflict with anything else in these Terms, these provisions control with respect to the iOS application.

15.1 Acknowledgment

These Terms are concluded between you and FortuneTell.ai only, and not with Apple. FortuneTell.ai, not Apple, is solely responsible for the iOS application and its content.

15.2 Scope of License

FortuneTell.ai grants you a non-transferable license to use the iOS application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the iOS application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

15.3 Maintenance and Support

FortuneTell.ai is solely responsible for providing any maintenance and support services with respect to the iOS application, as specified in these Terms or as required under applicable law. You may direct maintenance and support inquiries to support@fortunetell.ai. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the iOS application.

15.4 Warranty

FortuneTell.ai is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iOS application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the iOS application (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iOS application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be FortuneTell.ai's sole responsibility.

15.5 Product Claims

FortuneTell.ai, not Apple, is responsible for addressing any claims you or any third party may have relating to the iOS application or your possession and/or use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the iOS application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the iOS application's use of the HealthKit and HomeKit frameworks (if applicable).

15.6 Intellectual Property Rights

In the event of any third-party claim that the iOS application or your possession and use of the iOS application infringes that third party's intellectual property rights, FortuneTell.ai, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

15.7 Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

15.8 Third Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Changes to Terms

We may update these Terms. Material changes will be notified via email or in-app notice at least 7 days before taking effect. Continued use after changes constitutes acceptance.

17. Miscellaneous

• If any provision is found unenforceable, the rest remains in effect
• Our failure to enforce any provision is not a waiver
• These Terms are the entire agreement regarding the Service
